MY CARRIAGE LLC - PRIVATE LUXURY TRANSPORTATION - CLIENT SERVICES AGREEMENT & TERMS AND CONDITIONS
This Private Luxury Transportation Client Services Agreement ("Agreement") is entered into between My Carriage LLC, a Florida limited liability company ("My Carriage," "Company," "we," "us," or "our"), and the individual or entity purchasing or receiving transportation services ("Client," "Passenger," "you," or "your"). By creating an account, submitting a reservation, making a payment, or electronically accepting this Agreement, the Client acknowledges that the Client has read, understood, and agreed to these Terms and Conditions.
1. SERVICES PROVIDED
My Carriage LLC provides prearranged private luxury transportation services, which may include: - Airport transportation and transfers; - Airport Meet & Greet services; - Hotel and resort transportation; - Point-to-point transportation; - Cruise-port transportation; - Hourly transportation services; - Corporate transportation; - Special-event transportation; - Private transportation for families and groups; and - Other transportation services specifically agreed upon by the Company and Client. All services are subject to vehicle availability, applicable laws and regulations, airport and seaport requirements, and the operational policies applicable to the particular service.
2. PREARRANGED RESERVATIONS
My Carriage LLC provides transportation primarily through prearranged reservations. A reservation is considered confirmed when the Company has accepted the reservation and the required payment, deposit, or other booking requirements have been satisfied. The Client is responsible for providing accurate and complete information, including, when applicable: - Passenger name; - Telephone number; - Email address; - Pickup location; - Destination; - Date and time of service; - Number of passengers; - Luggage requirements; - Flight information; - Cruise information; - Child-seat requirements; and - Any other information necessary to provide the requested service. The Company is not responsible for additional costs, delays, missed transportation, or service difficulties resulting from inaccurate or incomplete information supplied by the Client.
3. RESERVATION CONFIRMATION
Submitting a reservation request does not necessarily constitute acceptance of the reservation. The Company may review the requested service, availability, vehicle requirements, pickup location, destination, and other applicable circumstances before confirming the reservation. Once confirmed, the Client will receive the applicable reservation details, including the scheduled pickup time, location, service type, and applicable charges.
4. AIRPORT MEET & GREET PROCEDURE
For prearranged Airport Meet & Greet reservations, the Client is expected to communicate with the assigned chauffeur as soon as the aircraft reaches the gate and the Client is preparing to deplane. This communication allows the chauffeur to coordinate the airport pickup process appropriately. Once the aircraft reaches the gate and the Client has communicated with the chauffeur, the chauffeur will: - Proceed to the assigned airport terminal; - Complete any required commercial-vehicle/security inspection or authorization process; - Proceed to the designated commercial parking or express commercial lane; - Park in accordance with applicable airport requirements; - Walk to the designated Meet & Greet area; and - Receive the Client and assist with the transportation process. Airport pickup procedures may vary depending upon airport regulations, security requirements, terminal restrictions, traffic conditions, and designated commercial-vehicle procedures. The Client agrees to follow the pickup instructions provided by the chauffeur.
5. AIRPORT LUGGAGE & TERMINAL WAITING TIME
When the Client has communicated with the chauffeur and the chauffeur has initiated the Airport Meet & Greet process, My Carriage LLC provides a sixty (60) minute complimentary waiting period. This period is intended to allow reasonable time for the Client to: - Deplane; - Retrieve checked luggage; - Proceed through the terminal; and - Meet the chauffeur at the designated Meet & Greet location. After the 60-minute complimentary period has expired, additional waiting charges apply as follows: - First additional 30 minutes: $15.00 - Second additional 30 minutes: $20.00 These charges apply to extended waiting associated with luggage retrieval, terminal processing, or the Client's continued progress toward the designated Meet & Greet location. This policy applies when the Client has responded and is actively proceeding toward the pickup. It is separate from the Airport No-Show Policy.
6. AIRPORT NO-SHOW POLICY
The Airport No-Show Policy applies when the Client does not respond to the chauffeur after the aircraft reaches the gate. The forty-five (45) minute No-Show period begins when the aircraft reaches the gate. The chauffeur will make reasonable attempts to contact the Client using the contact information provided with the reservation. If, after 45 minutes: - The Client has not responded; - The Client cannot be located; - The chauffeur has made reasonable attempts to establish communication; and - The Client has not presented for the scheduled Meet & Greet, the chauffeur may terminate the airport pickup process and leave the designated Meet & Greet/pickup area. The reservation will then be classified as a No-Show. No-Show Charge A confirmed Airport No-Show is subject to a charge of 100% of the applicable transportation fare. The Client understands that the 45-minute No-Show period is not the same as the 60-minute complimentary Airport Luggage & Terminal Waiting Period. The 60-minute period applies when the Client has communicated with the chauffeur and the chauffeur is actively providing or awaiting completion of the Meet & Greet service. The 45-minute period applies when the Client has not responded and cannot be located.
7. POINT-TO-POINT TRANSPORTATION WAITING TIME
For prearranged point-to-point transportation, the scheduled pickup time establishes the beginning of the waiting period. The Client receives a fifteen (15) minute complimentary grace period following the scheduled pickup time. Minutes 16-30 If the Client has not arrived after the first 15 minutes, the chauffeur will make reasonable attempts to contact the Client. If the Client communicates with the chauffeur and requests additional waiting time, waiting time from minute 16 through minute 30 will be charged at $0.80 per minute. After 30 Minutes If the Client communicates with the chauffeur and requests that the chauffeur continue waiting beyond 30 minutes, the chauffeur may, subject to availability and operational circumstances, continue waiting at a rate of: $1.25 per minute after the 30-minute mark. The Client understands that continued waiting beyond 30 minutes is not guaranteed and remains subject to the chauffeur's availability, subsequent reservations, traffic conditions, airport/venue restrictions, and other operational circumstances. No Communication After 30 Minutes If the Client has not responded to the chauffeur's reasonable attempts to establish communication by the expiration of the 30-minute period, the chauffeur may cancel the reservation and leave the pickup location. The reservation will then be classified as a No-Show, and 100% of the applicable transportation fare will be charged. The chauffeur's documented arrival, waiting time, communication attempts, and any communication received from the Client may be retained as evidence of the circumstances surrounding the reservation. This Point-to-Point Waiting Policy does not apply to Hourly Transportation.
8. HOURLY TRANSPORTATION
Hourly transportation is a separate service and is governed by the hourly rate and minimum service period disclosed to the Client at the time of booking. Unless otherwise agreed in writing, hourly service begins at the scheduled pickup time and continues until the Client releases the vehicle and chauffeur. Additional time requested by the Client may be charged at the applicable hourly rate or other rate disclosed at the time of reservation. The point-to-point 15-minute waiting/grace period does not apply to hourly service.
9. CRUISE-PORT TRANSPORTATION
Cruise-port transportation may be affected by: - Cruise-line schedules; - Port security; - Terminal restrictions; - Passenger disembarkation procedures; - Customs and immigration procedures; - Vessel arrival or departure changes; - Traffic; - Weather; - Port operational requirements; and - Government or security requirements. The Company does not control cruise-line or port operations. Clients are responsible for providing accurate cruise information and promptly communicating significant changes to their itinerary. Additional waiting or operational charges may apply when the Client's circumstances require additional chauffeur or vehicle time.
10. CANCELLATION POLICY
The following cancellation schedule applies to voluntary cancellations made by the Client. Cancellation charges are calculated based upon the amount of notice provided before the scheduled pickup time. More Than 24 Hours Before Service Cancellation received more than 24 hours before the scheduled pickup time: 25% non-refundable cancellation fee. The remaining 75% of the eligible reservation amount may be refunded. 24 Hours or Less, but More Than 6 Hours Before Service Cancellation received 24 hours or less but more than 6 hours before the scheduled pickup time: 50% non-refundable cancellation fee. The remaining 50% of the eligible reservation amount may be refunded. 6 Hours or Less Before Service Cancellation received 6 hours or less before the scheduled pickup time: 75% non-refundable cancellation fee. The remaining 25% of the eligible reservation amount may be refunded. No-Show A confirmed No-Show is subject to: 100% of the applicable transportation fare. No-Show charges are governed by the applicable No-Show provisions of this Agreement.
11. HOW TO CANCEL
A Client may cancel a reservation by email or by phone: - Email: Mycarriagellc@Yahoo.com - Phone: (407) 726-0459 A cancellation is effective when the Company receives the cancellation notice by email or phone. The Client should receive confirmation from My Carriage LLC that the cancellation has been received. Failure to appear for a confirmed reservation without timely cancellation constitutes a No-Show and is not treated as a voluntary cancellation.
12. UNFORESEEN EVENTS & THIRD-PARTY CANCELLATIONS
The standard cancellation schedule is intended primarily for voluntary cancellations by the Client. Different treatment may apply when transportation cannot reasonably be provided because of an unforeseen event or a cancellation or significant disruption caused by a third party. Examples may include: - Airline cancellation; - Significant airline schedule disruption; - Cruise-line cancellation; - Significant cruise itinerary change; - Airport closure; - Seaport closure; - Government restrictions; - Severe weather; - Natural disaster; - Road closure; - Emergency conditions; or - Other circumstances beyond the reasonable control of the Client or Company.
13. DOCUMENTATION OF THIRD-PARTY EVENTS
When requesting an exception to the standard cancellation policy, the Client may be required to provide reasonable documentation supporting the event. Examples include: - Airline cancellation confirmation; - Airline schedule-change notification; - Cruise-line cancellation notification; - Cruise itinerary-change notification; - Airport notification; - Port notification; or - Other official documentation from the applicable third party. The Client should notify My Carriage LLC as soon as reasonably possible after becoming aware of the event. My Carriage LLC may independently verify publicly available information when appropriate.
14. UNFORESEEN-EVENT CANCELLATION DETERMINATION
After reviewing the circumstances and available documentation, My Carriage LLC may determine whether an exception to the standard cancellation schedule is appropriate. Depending upon the circumstances, the Company may: - Waive the applicable cancellation fee; - Reduce the applicable cancellation fee; - Provide a partial refund; - Provide a full refund; or - Offer another reasonable resolution. An exception granted in one circumstance does not create an obligation to grant the same exception in another circumstance.
15. THIRD-PARTY DELAYS
A third-party delay does not automatically constitute a cancellation. For example, an airline delay may result in a change to the Client's expected pickup time rather than cancellation of the reservation. Where reasonably possible, My Carriage LLC may attempt to accommodate the revised itinerary, subject to vehicle and chauffeur availability and applicable operational requirements. Additional waiting, scheduling, or service charges may apply when a third-party delay requires additional resources or extended service.
16. PRICING AND PAYMENT
The price for transportation will be provided to the Client before or during the booking process. Payment or an authorized payment method may be required to confirm a reservation. The Client authorizes My Carriage LLC to charge applicable amounts associated with the reservation, including: - Agreed transportation fare; - Additional waiting time; - Additional hourly service; - Cancellation charges; - No-Show charges; - Applicable parking charges; - Applicable tolls; - Airport or port fees disclosed to the Client; - Extraordinary cleaning; and - Damage caused by the Client or passengers.
17. TOLLS, PARKING AND THIRD-PARTY FEES
Unless specifically included in the quoted transportation price, applicable tolls, parking charges, airport fees, port fees, or other third-party charges may be passed through to the Client when disclosed or authorized under the reservation. Airport and port requirements may result in fees that vary depending upon the location and circumstances of the reservation.
18. PASSENGER AND LUGGAGE INFORMATION
The Client must provide accurate passenger and luggage information. Passenger capacity and luggage capacity are subject to the legal and safe capacity of the vehicle assigned. If the number of passengers or amount of luggage exceeds the vehicle's safe or legal capacity, the Company may require an additional vehicle or may be unable to provide the requested transportation. Additional charges may apply.
19. PERSONAL PROPERTY
Passengers are responsible for their personal belongings. The Company is not responsible for property left behind in a vehicle except to the extent responsibility is imposed by applicable law. Passengers should inspect the vehicle before leaving. If an item is found, the Company will make reasonable efforts to return it to its owner. Any shipping or transportation costs associated with returning lost property may be the responsibility of the Client.
20. CHILDREN AND SAFETY SEATS
The Client must notify My Carriage LLC in advance when children or infants will be transported. All applicable child-restraint and safety requirements must be followed. If a child safety seat is requested from My Carriage LLC, availability and applicable charges will be disclosed during the reservation process.
21. PASSENGER CONDUCT
Passengers must behave in a safe and respectful manner toward chauffeurs, passengers, vehicles, and property. The following conduct is prohibited: - Violence or threats; - Harassment; - Deliberate damage; - Interference with safe vehicle operation; - Illegal activity; - Conduct creating an unsafe environment; - Smoking or vaping where prohibited; or - Conduct violating applicable law. The chauffeur may terminate transportation when reasonably necessary to protect the safety of passengers, the chauffeur, the vehicle, or the public. The Client may remain responsible for the reservation amount and reasonable costs associated with damage or extraordinary cleaning caused by passenger misconduct.
22. SMOKING, VAPING AND VEHICLE CLEANING
Smoking and vaping are prohibited in Company vehicles unless expressly permitted. Passengers may be charged for extraordinary cleaning, restoration, repair, stains, spills, odors, bodily fluids, smoking, vaping, or other damage caused by passengers.

Clients and passengers may not request or encourage the chauffeur to: - Violate traffic laws; - Exceed legal speed limits; - Operate the vehicle unsafely; - Stop in prohibited areas; or - Violate airport, port, municipal, or other transportation requirements. The chauffeur retains authority concerning the safe operation of the vehicle.
24. TRAFFIC, WEATHER AND UNFORESEEN CONDITIONS
My Carriage LLC does not guarantee a specific travel time when circumstances outside the Company's reasonable control affect transportation. Such circumstances may include: - Traffic congestion; - Accidents; - Road closures; - Construction; - Severe weather; - Natural disasters; - Emergency conditions; - Government restrictions; - Airport or port delays; - Law-enforcement activity; - Mechanical emergencies; or - Other circumstances beyond the Company's reasonable control. The Company will make reasonable efforts to fulfill the reservation under the circumstances.
25. VEHICLE SUBSTITUTION
The Company may substitute a vehicle when reasonably necessary because of: - Mechanical issues; - Maintenance; - Safety concerns; - Vehicle availability; - Emergency circumstances; - Weather; - Operational requirements; or - Other circumstances beyond the Company's reasonable control. When reasonably possible, the Company will provide a comparable vehicle.
26. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, My Carriage LLC will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from transportation services, including losses associated with missed flights, cruises, events, business opportunities, or other consequential losses, except where such limitation is prohibited by applicable law. Nothing in this Agreement is intended to waive or limit liability that cannot legally be waived or limited.
27. THIRD-PARTY SERVICES AND SCHEDULES
My Carriage LLC does not control the operations of airlines, cruise lines, airports, seaports, hotels, venues, traffic authorities, or other third parties. 29. ELECTRONIC ACCEPTANCE
The Client agrees that electronic acceptance of this Agreement-including selecting an "I Agree" checkbox, clicking a confirmation button, submitting a reservation, or otherwise electronically accepting the Agreement-constitutes the Client's electronic signature and acceptance of these Terms. The Company may retain electronic records showing the Client's acceptance, reservation details, communications, payments, cancellations, and other transaction information.
30. RECORDS OF COMMUNICATION AND SERVICE
My Carriage LLC may maintain records reasonably necessary to document reservations and transportation services. Such records may include: - Reservation confirmations; - Payment records; - Cancellation requests; - Client communications; - Chauffeur communications; - Call or message records; - Flight information; - Aircraft gate-arrival information; - Chauffeur arrival records; - Waiting-time records; - No-Show documentation; - Photographs or other operational records where appropriate; and - Other records reasonably related to the reservation. These records may be used to document the Company's performance and the circumstances surrounding waiting-time charges, cancellations, No-Shows, refunds, or disputes.
31. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise. Any dispute shall be brought in a court of competent jurisdiction in the appropriate Florida venue, subject to applicable law concerning jurisdiction, venue, arbitration, or consumer rights.
32. SEVERABILITY
If any provision of this Agreement is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in effect to the maximum extent permitted by law.
33. NO WAIVER
Failure by My Carriage LLC to enforce any provision of this Agreement does not constitute a waiver of the Company's right to enforce that provision in the future.
34. ENTIRE AGREEMENT
This Agreement, together with the Client's reservation confirmation, applicable pricing, cancellation policy, Privacy Policy, and other terms expressly incorporated into the reservation, constitutes the agreement between My Carriage LLC and the Client regarding the transportation services purchased.
